1. Acceptance of Terms

By downloading, installing, accessing, or using the OBDY mobile application (the "Application"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Application.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and OBDY ("we," "us," or "our"), the provider of the Application. These Terms apply to all users of the Application, including users who have registered accounts and users who access the Application without registration.

If you are using the Application on behalf of an organisation, you represent and warrant that you are authorised to bind that organisation to these Terms.

2. Description of Service

OBDY is a mobile application that enables users to:

  • Create and manage a user account and vehicle profile, including vehicle identification information where you choose to provide it;
  • Connect to a compatible Bluetooth OBD2 diagnostic dongle so the Application can read information made available by the vehicle's On-Board Diagnostics system;
  • Display live, read-only engine and driving parameters such as RPM, speed, fuel level, coolant temperature, throttle position, and similar values when supported by the vehicle and dongle;
  • Scan, display, and store Diagnostic Trouble Codes (DTCs), including code descriptions, severity indicators, active or resolved status, and scan history;
  • Show road and safety context such as weather, road surface conditions, visibility, traffic, nearby fuel prices, and electric vehicle (EV) charging information where location access and third-party data are available;
  • Provide fuel, eco, and vehicle context features based on available vehicle, location, weather, and open data sources;
  • Use the AI Co-pilot feature, powered by Google Gemini, to discuss vehicle diagnostics, maintenance questions, images, and related topics through text, image, and voice input.

The Application is an informational and read-only companion. It is intended to read and present data made available by your vehicle, compatible dongle, and third-party data providers. The Application and dongle do not repair, service, tune, modify, disable, clear, or otherwise control your vehicle, its engine, braking, steering, safety systems, emissions systems, or electronic control units.

The Application requires a compatible OBD2 Bluetooth diagnostic dongle to access vehicle diagnostics features. Unless we expressly state otherwise in writing, the dongle is separate hardware and may be supplied by a third party. Compatibility with specific vehicles, dongles, protocols, or diagnostic functions is not guaranteed.

3. Eligibility

To use the Application, you must:

(a) Be at least 16 years of age. The Application is not intended for use by persons under 16, consistent with the minimum age for digital service consent under applicable EU law.

(b) Have lawful access to and use of the vehicle you are monitoring. You must not use the Application to access diagnostic data from a vehicle without the owner's knowledge and consent.

(c) Comply with all applicable local, national, and international laws and regulations in connection with your use of the Application.

By using the Application, you represent and warrant that you meet these eligibility requirements.

4. Account Registration

4.1 Creating an Account

Access to certain features of the Application requires you to create a user account. You may register using an email address and password or through a supported social login provider (Google, Apple, or Facebook).

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

  • Choose a strong, unique password and keep it confidential;
  • Notify us immediately at go@obdy.app if you suspect unauthorised access to your account;
  • Accept responsibility for all activities that occur under your account.

We are not liable for any loss or damage arising from unauthorised use of your account where you have failed to take reasonable precautions to protect your credentials.

4.3 Account Accuracy

You agree to provide accurate, current, and complete information when creating your account and to keep your account information up to date.

4.4 Account Deletion

You may delete your account at any time through the Application (Settings → Account → Delete Account). Account deletion permanently removes all personal data associated with your account from our systems, as described in our Privacy Policy.

5. Permitted Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the Application on a mobile device that you own or control, solely for your personal, non-commercial purposes.

6. Prohibited Uses

You agree not to:

(a) Use the Application for any unlawful purpose or in any manner inconsistent with these Terms;

(b) Access or monitor a vehicle's diagnostic system without the owner's explicit consent;

(c) Use the Application while operating a vehicle. You must stop your vehicle safely before interacting with the Application;

(d) Use the Application, AI Co-pilot, or diagnostic data as the sole basis for deciding that a vehicle is safe to drive, safe to repair, compliant with law, or free from faults;

(e) Ignore dashboard warnings, manufacturer instructions, legal inspection requirements, recall notices, professional advice, or obvious vehicle symptoms because of information shown in the Application;

(f) Attempt to use the Application or any dongle connected to it to modify, tune, reprogram, disable, clear, bypass, or interfere with any vehicle system, diagnostic code, safety feature, emissions feature, odometer, security system, or electronic control unit;

(g) Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the Application;

(h) Attempt to gain unauthorised access to any part of the Application, its servers, databases, or infrastructure;

(i) Use automated tools, bots, scrapers, or scripts to extract, harvest, or systematically collect data from the Application;

(j) Commercially resell, sublicense, or redistribute vehicle diagnostic data or AI Co-pilot outputs obtained through the Application;

(k) Use the AI Co-pilot outputs as a substitute for or as if they constituted professional mechanical, engineering, or safety certification advice;

(l) Transmit through the Application any content that is unlawful, harmful, defamatory, obscene, or that infringes the intellectual property rights of any third party;

(m) Interfere with or disrupt the integrity or performance of the Application or its underlying infrastructure;

(n) Circumvent, disable, or interfere with any security features of the Application.

7. AI Co-pilot

7.1 Nature of the Service

The AI Co-pilot is an AI-powered conversational assistant integrated into the Application. It is designed to assist users with general vehicle-related questions, interpretation of diagnostic data, and maintenance guidance.

The AI Co-pilot is powered by Google Gemini, a generative artificial intelligence service provided by Google LLC. Your use of the AI Co-pilot is also subject to Google's applicable terms and policies for the Gemini API.

7.2 Informational Purposes Only

AI Co-pilot responses are provided for informational and general guidance purposes only. They do not constitute professional mechanical advice, engineering analysis, vehicle safety certification, or legal advice. We make no warranty regarding the accuracy, completeness, reliability, or fitness for purpose of any AI-generated response.

You should not rely solely on AI Co-pilot output for any safety-critical decision. Always verify AI-generated diagnostic interpretations with a qualified, certified vehicle mechanic before undertaking any repair, modification, or safety-relevant action on your vehicle.

7.3 Camera and Microphone Access

The AI Co-pilot may request access to your device's camera, microphone, and photo library:

  • Camera / Photo Library: To allow you to send images of your vehicle, components, or dashboard to the AI for analysis.
  • Microphone: To allow you to dictate messages by voice. Voice recordings are transcribed to text using Google Gemini. The audio recording is discarded immediately after transcription; the text transcript is stored as a message in your conversation history.

These permissions are optional. You may use the AI Co-pilot via text input without granting camera or microphone access. You may revoke permissions at any time in your device's operating system settings.

7.4 Conversation Storage

AI Co-pilot conversations, including your text messages, AI responses, and attached images, are stored on our servers to allow you to access and continue previous conversations. Stored conversations are subject to the data retention terms described in our Privacy Policy. You may delete individual conversations or all conversations through the Application at any time.

7.5 AI Limitations

Artificial intelligence systems can produce incorrect, misleading, or hallucinated outputs. We are not responsible for decisions you make in reliance on AI Co-pilot outputs. We expressly disclaim any liability for vehicle damage, personal injury, or other harm arising from your reliance on AI-generated content.

8. Vehicle Safety Disclaimer

THIS SECTION IS IMPORTANT. PLEASE READ CAREFULLY.

8.1 Not a Substitute for Professional Inspection. OBDY is a consumer-grade diagnostic tool intended to assist vehicle owners in understanding their vehicle's status. It is not a substitute for inspection by a certified, professional mechanic using calibrated diagnostic equipment. Diagnostic Trouble Codes (DTCs) and other data presented in the Application are indicative only and may not reflect the full mechanical condition of the vehicle.

8.2 You Remain Fully Responsible for the Vehicle. You are fully responsible for the ownership, condition, maintenance, repair, inspection, roadworthiness, legal compliance, and safe operation of any vehicle used with the Application or dongle. You are also responsible for deciding whether to drive, stop driving, seek professional help, repair a fault, ignore a fault, or take any other action connected with the vehicle.

8.3 Read-Only Information; No Vehicle Control. The Application and dongle are intended only to request, receive, display, and store diagnostic and contextual information. They do not perform repairs, maintenance, calibration, coding, tuning, adaptation, clearing of faults, or any control action on the vehicle. We are not responsible for any existing, developing, hidden, intermittent, or future vehicle faults, failures, warnings, breakdowns, accidents, emissions issues, inspection failures, service costs, loss of use, or reduction in value.

8.4 No Guarantee of Accuracy. Vehicle diagnostic data depends on the vehicle, the dongle, the OBD system, supported protocols, sensor condition, vehicle manufacturer behaviour, phone Bluetooth behaviour, connectivity, and third-party data sources. We do not warrant that diagnostic data, DTC descriptions, road data, fuel data, EV charging data, weather data, AI output, or any other information shown in the Application is accurate, complete, current, available, or suitable for your vehicle or situation.

8.5 Do Not Drive While Using the App. Operating a mobile device while driving is dangerous and illegal in many jurisdictions. You must stop your vehicle safely before using the Application. We accept no liability for accidents, injuries, fines, penalties, or damage arising from use of the Application while driving or from unsafe placement or use of a mobile device or dongle.

8.6 Repair and Driving Decisions. Any decision to repair, modify, maintain, inspect, sell, buy, insure, or operate a vehicle should be made by you and, where appropriate, with the guidance of a qualified professional. We accept no responsibility for vehicle damage, personal injury, property damage, financial loss, legal consequences, or other harm arising from actions or inaction based on information provided by the Application, dongle, AI Co-pilot, or third-party services.

9. Third-Party Hardware

The Application is designed to work with compatible OBD2 Bluetooth diagnostic dongles. Unless we expressly state otherwise in writing, we do not manufacture, sell, install, inspect, certify, or warrant any hardware. You are responsible for choosing, purchasing, installing, removing, securing, and using any dongle safely and lawfully.

The dongle and Application are intended to read diagnostic information only. They are not intended to make changes to your vehicle. You must not use any dongle in a way that interferes with vehicle operation, creates a distraction, drains the battery, blocks pedals or controls, violates law, voids a warranty, or creates a safety risk.

We do not guarantee:

  • That any specific OBD2 dongle will be compatible with the Application or your vehicle;
  • The accuracy or reliability of data transmitted by third-party hardware;
  • The availability or performance of hardware manufactured or sold by third parties;
  • That use of any dongle will be accepted by a vehicle manufacturer, insurer, leasing company, inspection authority, or warranty provider.

We accept no liability for damage to your vehicle, its battery, electronic systems, components, warranty position, insurance position, or any other property arising from the installation, removal, compatibility, failure, malfunction, placement, or use of any dongle in connection with the Application.

10. Third-Party Services

The Application relies on the following third-party services to operate:

  • Supabase — backend database, authentication, and cloud storage
  • Google Gemini (Google LLC) — AI Co-pilot processing
  • AutoRef — vehicle identification and catalogue data
  • OpenWeather — weather and environmental data
  • Google, Apple, and Facebook — social authentication providers (optional)
  • Road and fuel open data providers — traffic, road weather, fuel prices, and EV charger information

These services are provided by independent third parties. We do not control and are not responsible for the availability, reliability, or content of third-party services. Interruptions or errors in third-party services may affect the functionality of the Application. We will not be liable for any loss or damage arising from the unavailability or malfunction of third-party services.

Your use of social login providers (Google, Apple, Facebook) is additionally governed by the respective provider's terms of service and privacy policy.

11. Intellectual Property

11.1 Our Property

The Application, including its source code, design, user interface, graphics, text, features, and all content developed or provided by us, is owned by OBDY or its licensors and is protected by copyright, trademark, and other applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, trade names, logos, or other brand identifiers.

11.2 Your Content

You retain ownership of any content you submit or upload through the Application, including messages, images, and voice input submitted to AI Co-pilot ("User Content"). By submitting User Content, you grant us a limited, non-exclusive, worldwide, royalty-free licence to store, process, and transmit your User Content solely to the extent necessary to operate the Application and provide the services described in these Terms. This licence terminates upon deletion of the content or deletion of your account.

You represent and warrant that your User Content does not infringe the intellectual property rights, privacy rights, or other rights of any third party.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION AND ALL SERVICES PROVIDED THEREUNDER ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE;
  • ANY DEFECTS WILL BE CORRECTED;
  • THE APPLICATION OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
  • DIAGNOSTIC DATA RETRIEVED THROUGH THE APPLICATION IS ACCURATE, COMPLETE, OR CURRENT;
  • THE APPLICATION, DONGLE, AI CO-PILOT, OR ANY INFORMATION SHOWN IN THE APPLICATION WILL IDENTIFY, PREVENT, PREDICT, EXPLAIN, OR RESOLVE ANY VEHICLE FAULT, SAFETY ISSUE, BREAKDOWN, REPAIR NEED, EMISSIONS ISSUE, OR LEGAL COMPLIANCE ISSUE.

Nothing in this Section limits any consumer rights you may have under applicable EU consumer protection law that cannot be excluded or limited by contract.

13. Limitation of Liability

13.1 Exclusion of Consequential Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OBDY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR PERSONAL INJURY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APPLICATION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13.2 Vehicle Damage

WE SHALL NOT BE LIABLE FOR ANY DAMAGE, FAULT, FAILURE, WARNING LIGHT, BREAKDOWN, LOSS OF WARRANTY, INSURANCE ISSUE, INSPECTION FAILURE, SERVICE COST, REPAIR COST, LOSS OF USE, REDUCTION IN VEHICLE VALUE, OR OTHER VEHICLE-RELATED LOSS ARISING FROM OR ALLEGED TO ARISE FROM YOUR USE OF, INABILITY TO USE, OR RELIANCE ON THE APPLICATION, ANY DONGLE, DIAGNOSTIC DATA, DTC DESCRIPTION, AI CO-PILOT OUTPUT, ROAD DATA, WEATHER DATA, FUEL DATA, EV CHARGING DATA, OR RECOMMENDATION PROVIDED THROUGH THE APPLICATION.

YOU ACKNOWLEDGE THAT VEHICLE FAULTS MAY EXIST BEFORE USE OF THE APPLICATION OR MAY DEVELOP INDEPENDENTLY OF THE APPLICATION OR DONGLE. THE APPLICATION AND DONGLE DO NOT CAUSE REPAIRS TO BE PERFORMED, DO NOT CERTIFY VEHICLE CONDITION, AND DO NOT TRANSFER RESPONSIBILITY FOR THE VEHICLE FROM YOU TO US.

13.3 Aggregate Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE APPLICATION SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) EUR 50.

13.4 Consumer Rights

Nothing in this Section 13 limits or excludes any liability that cannot be lawfully excluded under Lithuanian law or applicable EU consumer protection legislation, including but not limited to liability for death or personal injury caused by our negligence, or liability for fraud or fraudulent misrepresentation.

14. Indemnification

You agree to indemnify, defend, and hold harmless OBDY and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to:

(a) your use of or access to the Application;
(b) your violation of these Terms;
(c) your violation of any applicable law or regulation;
(d) your User Content;
(e) any misrepresentation made by you.

15. Termination

15.1 Termination by You

You may stop using the Application and delete your account at any time through the Application's Settings. Upon account deletion, these Terms will terminate with respect to you, except for provisions that by their nature should survive termination (including Sections 11, 12, 13, 14, and 16).

15.2 Termination or Suspension by Us

We reserve the right to suspend or terminate your account or access to the Application, with or without notice, if:

(a) you materially breach these Terms;
(b) we are required to do so by applicable law or a court order;
(c) your continued use poses a risk to the security, integrity, or operation of the Application or to other users.

Where we suspend or terminate your account without cause, we will provide reasonable notice where practicable.

15.3 Effect of Termination

Upon termination, your licence to use the Application ceases immediately. Termination does not affect any rights or obligations that have accrued prior to the date of termination.

16. Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of Lithuania, without regard to its conflict of law provisions.

Nothing in these Terms affects your rights as a consumer under mandatory provisions of the law of your country of residence within the European Union.

17. Dispute Resolution

17.1 Informal Resolution

Before initiating formal legal proceedings, you agree to first contact us at go@obdy.app and give us a reasonable opportunity (not less than 30 days) to resolve the dispute informally.

17.2 Jurisdiction

If a dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the competent courts of the Republic of Lithuania, subject to any mandatory provisions of EU law that may grant jurisdiction to courts in your country of residence.

17.3 EU Online Dispute Resolution

If you are a consumer resident in the European Union, you may also submit a complaint through the EU Online Dispute Resolution (ODR) platform:

18. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this document. We will provide reasonable notice of material changes through the Application or by email to the address associated with your account.

Your continued use of the Application after the updated Effective Date constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Application and may delete your account.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy (available at /privacy-policy), constitute the entire agreement between you and OBDY regarding your use of the Application and supersede all prior agreements, representations, and understandings relating to the same subject matter.
